For each order you place with us, the following text is a binding part of the sales contract:
1 The [importer/buyer] shall not sell, export or re-export, directly or indirectly, to the Russian Federation or for use in the Russian Federation any goods supplied under or in connection with this Agreement that fall within the scope of Article 12g of Council Regulation (EU) No 833/2014.
2 The [importer/buyer] shall use its best endeavors to ensure that the purpose of paragraph (1) is not frustrated by third parties in the wider chain of commerce, including potential resellers.
3 The [importer/buyer] shall establish and maintain an appropriate monitoring mechanism to detect conduct by third parties in the downstream chain, including potential resellers, that would defeat the purpose of paragraph (1).
4 Any breach of paragraphs (1), (2) or (3) shall constitute a material breach of a material element of this Agreement and the [exporter/seller] shall be entitled to seek appropriate remedies, including but not limited to: Termination of this Agreement. In addition, the Seller shall be entitled to notify all appropriate governmental authorities of the incident.
5 The [importer/buyer] shall promptly notify the [exporter/seller] of any problems in the application of paragraphs (1), (2) or (3), including any relevant third party activities that may frustrate the purpose of paragraph (1). The [importer/buyer] shall provide the [exporter/seller] with information on compliance with the obligations set out in paragraphs (1), (2) and (3) within two weeks of the simple request for such information."
Due to the sanctions imposed by the European Union against Russia and Belarus, we will no longer be issuing quotations or making deliveries to Russia and Belarus from 24.02.2022. These measures also apply to all inquiries concerning North Korea.
Pakistan, Iran, Syria, Iraq, Zimbabwe, Somalia, Sudan, South Sudan:
Due to the time-consuming processing to obtain a zero clearance certificate (no objection certificate) from the Federal Office of Economics and Export Control, we generally do not ship to the above countries. We reserve the right to add further countries to this list if the situation and legal regulations change.
Egypt
Due to the new ACI procedure (pre-registration of imports) and only rarely incoming inquiries from Egypt, we have stopped all deliveries to Egypt because of the high bureaucratic effort. We kindly ask interested parties to contact a German exporter specialized in Egypt if necessary.
