The EU Product Safety Regulation (Regulation 2023/988), which came into force on June 13, 2023 and is applicable from December 13, 2024, is primarily aimed at protecting consumers (B2C) and thus primarily regulates product safety in the context of the consumer market. Its focus is on ensuring that products made available to consumers in the EU are safe.
Applicability to B2C and B2B:
B2C customers (consumers): We do not supply B2C customers!
The regulation specifically aims to protect consumers from unsafe products and therefore applies primarily to products that are intended directly or indirectly for the end user.
B2B customers (companies):
The regulation also applies indirectly to B2B transactions if products in the supply chain are ultimately intended for consumers. Companies in the B2B supply chain (e.g. manufacturers, importers, wholesalers) are responsible for complying with product safety requirements, even if they do not sell directly to end users.
The regulation does not apply to products intended solely for industrial or professional use that have no connection to the consumer market.
Conclusion:
The EU General Product Safety Regulation (2023/988) is primarily designed to protect consumers (B2C), but it also affects B2B companies if their products are part of a supply chain that reaches consumers. Companies that produce exclusively for commercial customers (B2B) without end-user contact are not covered by this regulation.
